1. Purpose and scope
This Acceptable Use Policy (the “AUP”) applies to all use of the SubhX Nexus platform, APIs, mobile applications and related services (the “Service”) operated by Subhx Infotech OPC Pvt Ltd (“Subhx”, “we”, “us” or “our”). It supplements, and is incorporated into, our Terms & Conditions. Each organisation is responsible for ensuring its administrators, employees and other users comply with this AUP.
We may update this AUP from time to time. Material changes take effect when we update the “Last updated” date above, and your continued use of the Service after that constitutes acceptance.
2. Lawful use
- Use the Service only for legitimate business and HR purposes and in compliance with all applicable Indian laws, including data-protection, labour, employment, tax and anti-fraud laws, and any other laws that apply to you.
- Ensure you have a valid lawful basis and any required notices or consents before adding the personal data of employees, candidates or other individuals to the Service.
- Honour the rights of the individuals whose data you process, and use the Service's administrative tools to keep that data accurate and up to date.
- Comply with the terms of any third-party services you connect to the Service, including your email or messaging provider.
3. Prohibited content
You must not upload, store, transmit or make available through the Service any content that:
- Is unlawful, infringing, defamatory, obscene, harassing, hateful, or that promotes violence or discrimination.
- Infringes the intellectual-property, privacy, publicity or other rights of any person.
- Contains personal data you have no lawful basis or authority to process, or sensitive identifiers you are not permitted to collect.
- Contains malware, ransomware, spyware, or any code designed to disrupt, damage or gain unauthorised access to systems or data.
- Is intended to deceive, defraud, phish, or impersonate any person or organisation.
4. Prohibited conduct
You must not, and must not allow any user or third party to:
- Probe, scan or test the vulnerability of the Service, or breach or circumvent any security, authentication, rate-limit, usage-cap or billing control.
- Reverse-engineer, decompile, disassemble or attempt to derive the source code of the Service, except to the extent expressly permitted by law.
- Scrape, harvest or extract data from the Service by automated means other than through the documented API and within its limits.
- Interfere with or disrupt the integrity or performance of the Service, the infrastructure on which it runs, or the data of any other customer.
- Resell, sublicense, rent or operate the Service as a service bureau for third parties without our prior written consent.
- Use the Service to develop or train a competing product, or to benchmark it for that purpose, without our prior written consent.
5. Account and credential security
- Keep account credentials, one-time passcodes and devices secure, and do not share them or allow unauthorised persons to use your account.
- Configure user roles and permissions on a least-privilege basis, and promptly remove access for users who no longer need it.
- Notify us promptly at support@subhx.in if you suspect any unauthorised access to, or misuse of, your workspace or account.
- Do not attempt to access any account, workspace or data that you are not authorised to access.
6. Communications and messaging
Where the Service lets you send email, notifications, chat messages or other communications, you must use those features responsibly and lawfully. You must not use them to send unsolicited bulk messages, spam, or content that breaches this AUP or applicable law. Use of the connected mailbox add-on is additionally governed by our Email & Anti-Spam Policy.
7. Fair use and resource limits
- The Service is provided on a fair-use basis. We may apply reasonable limits on storage, API request rates, message volumes, file sizes and other resources to protect the stability of the platform for all customers.
- Metered features (for example, KYC verification and certain communications) are subject to the limits and charges shown in your workspace and are debited from your organisation's prepaid wallet on use.
- We may contact you if your usage materially exceeds normal patterns or threatens the performance of the Service, and we may apply temporary throttling to preserve availability.
8. Third-party services and integrations
The Service may let you connect third-party services, such as email providers and identity providers. You are responsible for your use of those services, for complying with their terms, and for the data you choose to share with them. We are not responsible for the availability, security or content of third-party services, and your use of them is at your own risk.
9. Reporting and enforcement
- If you become aware of any violation of this AUP, please report it to support@subhx.in with enough detail for us to investigate.
- We may investigate suspected violations and may remove or disable content, restrict features, or suspend or terminate access where we reasonably believe this AUP or the Terms have been breached.
- Where a violation poses an immediate risk to the Service, other customers or any person, we may act without prior notice; otherwise we will give reasonable notice where practicable.
- Serious or repeated violations, or any unlawful activity, may be referred to the relevant authorities.
10. Consequences of violation
A violation of this AUP is a breach of the Terms & Conditions. Depending on the severity, consequences may include warnings, content removal, feature restriction, suspension or termination of access, and recovery of any costs we reasonably incur as a result, all without prejudice to our other rights and remedies under the Terms and at law.
