1. Scope of this policy
This Email & Anti-Spam Policy applies to the connected-mailbox feature of the SubhX Nexus platform (the “Service”), operated by Subhx Infotech OPC Pvt Ltd (“Subhx”, “we”, “us” or “our”). It supplements our Terms & Conditions and Acceptable Use Policy, and applies to every user who connects or uses a mailbox through the Service.
2. What the mailbox add-on is — and is not
The connected-mailbox feature lets you link your own email account to SubhX Nexus so you can send and read messages from within the Service. It is important to understand what we provide:
- We provide a connection to your existing email provider using the credentials or authorisation you supply — an outbound SMTP connection for sending and an IMAP connection for reading — together with a local cache that stores recent messages so the Service is responsive.
- We do not operate a mail server on your behalf, and we are not your email provider. Your mailbox, mail storage and email address remain with your chosen provider.
- Mail is sent and received through your provider's infrastructure. We relay your instruction to send; your provider performs the actual delivery and applies its own rules, limits and filtering.
- Deliverability, mailbox reputation, sending limits and storage are determined by your provider, not by us.
3. Your responsibilities
- Connect only mailboxes you own or are authorised to use, and keep the connection credentials or authorisation secure.
- Comply with all applicable laws when sending email, including the Information Technology Act, 2000 and rules made under it, data-protection law, and consumer-protection and anti-fraud laws.
- Comply with the terms, acceptable-use policy and sending limits of your email provider. A breach of those terms is your responsibility and may lead your provider to suspend your mailbox.
- Ensure you have a lawful basis and, where required, consent to email the recipients you contact, and honour opt-outs and unsubscribe requests promptly.
4. Anti-spam rules
You must not use the connected-mailbox feature to:
- Send unsolicited bulk or commercial email (spam), or send to purchased, harvested or otherwise non-consented address lists.
- Send messages with false, misleading or forged header information, sender identity, subject lines or routing data.
- Send phishing, fraudulent, deceptive or impersonating messages, or messages designed to harvest credentials or personal data.
- Distribute malware, malicious links or attachments, or content that is unlawful, infringing, defamatory, obscene or harassing.
- Evade spam filters, sending limits or your provider's controls, including by rotating accounts or splitting volume to disguise bulk sending.
5. Permitted business use
The feature is intended for legitimate, individualised business correspondence — for example, communicating with employees, candidates and business contacts as part of your HR and operational workflows. Transactional and relationship messages that recipients expect, and that comply with law and your provider's terms, are permitted. The feature is not intended to be a bulk marketing or mass-mailing platform.
6. Caching and data handling
To make the mailbox responsive, the Service caches recent messages and related metadata that are synced from your provider over IMAP. This cached content is Customer Data, is stored within your workspace under your control, and is handled in accordance with our Privacy Policy and Data Processing Agreement. You can disconnect a mailbox at any time; on disconnection we stop syncing and remove the associated cached content within a reasonable period, subject to routine backup cycles.
7. Limits and fair use
- We may apply reasonable rate limits and volume limits on sending through the Service to protect the platform and to reduce the risk of your mailbox being flagged by your provider.
- These limits are in addition to, and do not override, any limits your email provider imposes.
- We may temporarily throttle or pause sending where we detect activity that appears abusive, automated beyond fair use, or likely to breach this policy.
8. Monitoring, suspension and enforcement
We do not routinely read the content of your messages. However, where we reasonably suspect a breach of this policy — for example, on receiving abuse reports or detecting patterns consistent with spam — we may investigate, suspend the connected-mailbox feature, or suspend or terminate access in accordance with the Terms & Conditions and Acceptable Use Policy. Where a breach poses an immediate risk, we may act without prior notice; otherwise we will give reasonable notice where practicable. We may also be required to cooperate with your email provider or with lawful authority.
9. Your liability
You are responsible for all messages sent through your connected mailbox and for any consequences arising from them, including action taken by your email provider or by recipients, and any claims, fines or costs resulting from a breach of this policy or applicable law. We are not liable for delivery failures, blocklisting or mailbox suspension imposed by your provider, which are outside our control.
